By placing a pet for adoption on AdoptAPet.com (the “Site”) or using any related applications or other services (the “Services) operated by Kinship Partners, Incorporated, a subsidiary of Mars, Incorporated (“AdoptAPet”), you, the individual rehoming a pet (“you” or “your”) agree to the AdoptAPet.com Terms of Service, Mars Terms of Use, and Privacy Policy as well as the following terms (“Rehome Terms”) that constitutes a legally binding agreement between AdoptAPet and you.
You represent and warrant that you are at least 18 years of age or the legal age of majority in your jurisdiction (whichever is greater) and that you have the full authority to enter into this agreement.
You certify that under all applicable laws and statutes, you are the legal owner or guardian of any pet you post for adoption and that you have the authority to transfer ownership to third parties on the site. If you found a pet and believe this pet to be a stray with no legal owner/guardian, you have made every reasonable effort to find the pet's owner prior to posting the pet for adoption including, but not limited to, calling any phone numbers present on a collar or tag, attempting to find an owner based on any information on a collar or tag including state or county license number, having the pet scanned for a microchip and contacting an owner based upon the results of the scan, placing flyers in your neighborhood and at your local animal shelter, and looking for flyers and classified “lost pet” ads in your neighborhood and online. You agree to follow all applicable laws governing the handling of stray animals. For example, in some cases, you may be required by law to take the pet to the nearest public shelter, where the owner may be searching for the pet. You understand that it is your responsibility to check with local animal control or other relevant governmental agency or regulatory authority for applicable laws governing stray animals in your city. AdoptAPet has no responsibility for the outcome of any adoption or rehoming, including if you change your mind about your decision to rehome or adopt a pet. You must address any concerns about a rehomed pet directly with the user with whom you transacted. You understand that the Site and Services are a tool to help you find a new home for your pet. AdoptAPet will not be responsible if you are unable to continue to provide a safe home for your pet. AdoptAPet makes no warranties or guarantees that it will be successful in helping you find your pet a home, or regarding any of its Services.
You agree that you are solely responsible for all communication with prospective adopters, and all decisions relating to choosing a new owner for your pet. You agree and acknowledge that any information provided through the Site or Services is its attempt to assist you, but that AdoptAPet does not make any warranty regarding such information and AdoptAPet and its affiliates and each of its and their respective licensors, suppliers, officers, directors, investors, employees, agents, service providers, sponsors, partners, and other contractors (the “AdoptAPet Parties”) are not liable for any outcome as a result of such information. The Site or Services are not intended to provide or act as a substitute for any qualified or certified professional advice on financial, psychological, medical, social, or veterinary matters. No guideline, suggestion, or content regarding pet adoption is appropriate for every situation, and you take full responsibility for all decisions and outcomes relating to rehoming your pet.
You acknowledge and agree that AdoptAPet shall have no responsibility or liability hereunder in connection with any dispute or legal claim that arises between you and a prospective adopter. AdoptAPet has no obligation to provide any refund, reimbursement, or other assistance to you in connection with any such dispute or claim, regardless of whether the Site or Services facilitated any communications between you and said prospective adopter. Your communications and transactions with prospective adopters and any other third parties through the Site and Services are conducted entirely at your own risk.
You agree to respond to all inquiries about your pet that you are listing for rehome on the Site or Services (“Your Pet”). You understand that it is very frustrating for a prospective adopter to inquire about pets for adoption and never hear back, and it often causes them to give up on adoption and purchase a pet instead. You will help keep people interested in pet adoption by being responsive.
You agree that you will conduct all communication with prospective adopters in a polite and respectful manner. Any profanity, harassment, or abuse will result in your pet listing being removed. If you receive profane, harassing, or abusive communications from a prospective adopter, you will let AdoptAPet know and AdoptAPet will make reasonable efforts to block them from communicating with you in the future through the Site or Services.
You understand that you are responsible for your own safety and for the safety of your pet. You will use utmost care and caution when arranging meetings with strangers. You will always bring a friend and meet in a public place. If you choose to share personal information with prospective adopters you do so at your own risk. You understand that if your intuition tells you something is off, it probably is. Regardless, YOU ACKNOWLEDGE AND AGREE THAT ADOPTAPET HAS NO CONTROL OVER ANY SUCH MEETING OR THE PERSONS THAT ATTEND SUCH MEETING AND HOLD THE ADOPTAPET PARTIES HARMLESS AND RELEASE THE ADOPTAPET PARTIES FROM ALL LIABILITY WITH REGARD TO SUCH MEETINGS AND THE ACTIONS OF PROSPECTIVE ADOPTERS OF YOUR PET WHICH YOU CONNECT WITH THROUGH THE SITE OR SERVICES.
In connection with the opportunity to place an adoption listing through the Site or Services, you agree to pay AdoptAPet a listing fee to be charged at the time of listing. You agree that AdoptAPet will not be liable or responsible for any fees, costs, expenses, or other charges due or payable to any owner, adopter, shelter, or other organization in connection with the adoption.
You agree to be truthful and accurate in the information you provide about yourself and your pet in your listing on the Site or Services and in offline activities and communication with prospective adopters. You agree to fully disclose any behavioral or health issues of your pet, without exceptions. You understand that failure to disclose known issues may result in your termination from the Site and Services, the removal of your listing, and other legal consequences.
YOU AGREE THAT TO THE MAXIMUM EXTENT PERMITTED UNDER APPLICABLE LAW, THE ADOPTAPET PARTIES SHALL NOT BE LIABLE FOR ANY CLAIMS, ACTIONS, INJURY, LOSS OR DAMAGE OF ANY KIND, INCLUDING, WITHOUT LIMITATION, THIRD PARTY CLAIMS; DIRECT, INDIRECT, CONSEQUENTIAL, INCIDENTAL, OR COMPENSATORY DAMAGES; LOSS OF A PET, INJURY TO YOURSELF OR ANY OTHER PERSON OR PET, OR LOSS OF LIFE, RESULTING FROM OR RELATING TO YOUR USE OF THE SITE OR SERVICES REHOMING SERVICES.
Your interactions with organizations or individuals found on or through the Site or Services are solely between you and such organizations or individuals. You agree to make whatever investigation you feel necessary or appropriate before proceeding with any interaction with any of these third parties. You agree that the AdoptAPet Parties are not responsible or liable for any loss or damage of any kind or nature incurred as the result of any of these dealings. If there is a dispute between users of the Site or Services, or between users and any third party, you understand and agree that the AdoptAPet Parties are under no obligation to become involved. In the event that you have a dispute with any other user of the Site or Services, you hereby release the AdoptAPet Parties from claims, demands, and damages (actual and consequential) of every kind or nature, known and unknown, suspected and unsuspected, disclosed and undisclosed, arising out of or in any way related to such disputes or Services.
You hereby certify that your pet has not been classified as dangerous or vicious by any law-enforcement agency or legal entity, or in your own estimation. You further certify that your pet has not caused the death of any human being or other dogs, cats, or at-home pets and that your pet has not bitten anyone prior to the use of the Site or Services rehome listing, in accordance with your responses to the questions and requests for information presented on the Site and Services during the listing process.
By posting Your Pet, you agree to complete the adoption through the Site and Services, unless the Site or Services had no part in facilitating the adoption. If you find an adopter by another means, you may still choose to use the Site or Services and tools to complete the adoption, and you understand that AdoptAPet encourages you to do so.
You agree to furnish any and all records to the adopter prior to adoption, including medical, vaccine, proof of spay/neuter, and microchip paperwork, if you have access to that paperwork.
If you were referred by an Animal Welfare Organization, you agree to allow your contact information to be shared with the organization for the sole purpose of supporting the adoption process.
By submitting a listing, you represent, warrant, and certify that you possess all necessary rights, licenses, consents, and authorizations required to list your pet for adoption or rehoming, and that such listing, adoption, and rehoming does not violate any legal duty or obligation that you owe to any third party (including without limitation any contractual or other legal restriction imposed by any shelter or similar organization).
